Building Rules

The following rules are amplifications of or in addition to the basic building rules that are described in the recorded documents of the Costa del Mar Homeowners Association.

Safety and Security:

• Do not prop doors and gates open. In no case should doors or gates be propped open and left unattended allowing the opportunity for unauthorized access to the elevator area, the garage, or the units themselves.

• Make sure the elevator area, garage, and beach access doors close and latch after you pass through. We have had five robberies because opportunistic thieves saw an open access.

• If you have service people who need access to the garage and you do not know them well, please monitor their presence carefully.

• Make sure the garage door is down (and stays down) when leaving the garage. Not checking that the garage door is coming down has been a cause of some of our security problems.

• Do not leave items in the stairwells or the foyer areas. This is a fire safety issue. (If an area were filled with smoke and without lights, any obstructions in that area could cause you to trip when exiting.)

Parking

• Each unit has two parking spaces Just because there are empty spaces in addition to the two you are eligible for does not mean that you are entitled to bring in a third car.

• Each car is required to have a parking sticker on the rear of the car. The sticker is simply a vinyl label stating the unit number of the car's owner. These stickers are easily removed. One source for the stickers is Home Depot

• Do not take up more than one parking space with a single car. Please park within the lines.

• (Note that parking is an even greater problem in the summer months and during Christmas vacation when non-resident owners often have two cars in the garage.)

Noise

• Please, no loud music or other loud noises between 10 PM and 8 AM. If there is a specific reason for the noise that cannot be prevented, please notify your neighbors 24 hours in advance so they can be prepared.

• Please remember that your floor may be someone else's ceiling. Any noise, especially on non-carpeted floor, carries right into the unit below. Please restrict vacuuming, heavy footfalls, wheeled toys, etc. especially on hard floor areas during the 10 PM to 8 AM period.

Garage and Storage

• No items are to be stored in the garage area unless they are in your own unit's storage room. No exceptions.

Common Area

• The roof is for the exclusive use of unit #6. You should not go onto the roof unless it is required for maintenance. For example, our heat pump/AC units are on the roof. If you need to have a service person go up there, please let the owner of #6 know at least 30 minutes ahead of time.

• The patio area from the south gate, west to the edge of the grass, and from there north to the gate that locks the stairs up to the units is for the exclusive use of the unit #1. Please respect this unit's privacy.

• The beach-side lawn is common area and is for the enjoyment of all. If you wish to have a larger than normal gathering using this area or wish to set up equipment or structures on the grass, please contact the Costa del Mar HOA to obtain board approval to reserve the area, and let all residents know the dates and times for your gathering. Note that any such use of the area will not be exclusive and residents will always have access to the area.

• Note that no reserved use will be permitted during “special” weekends such as Sandcastle Days when there is the expectation that everyone will want to make use of the lawn area for partying and watching fireworks, for example.

• The east and west stairs, the entry foyers, and the elevator are common areas which we all have a stake in keeping clean and unobstructed. We are a self-managed building and our cleaning lady only comes once per month. If you spill coffeee in the stairs or track in sand, please clean it up. There are cleaning supplies located in the cabinet below the mailboxes. The lock combination is 000.

• When replacing light bulbs in entry foyers, on the roof, in the stairwells, or in any lighting fixture that is on the main building power, use only low wattage fluorescent bulbs. A supply of the appropriate bulbs is normally kept in the supply cabinet below the mailboxes.

• No smoking in the elevator, garage, foyers, stairwells, and other enclosed common areas.

Use of Water for Cleaning

• Do not use a hose to clean the stairs down to the beach or the front stairwell. These are interior stairs and are not meant to have water on them. The water will leak into the building and must NEVER be used in these areas.

• Similarly, the 4th floor elevator foyer window must remain closed during rainy months because any water entering the foyer area permeates the building and the bedrooms below.

• When hosing off your decks, make sure that the water goes into the rain gutter and is not sprayed beyond the rain gutter. The water sprays down onto the windows or glass panel railings and this causes hard feelings for our neighbor to the south and the persons below who might have just cleaned their windows and glass panels.

Roof and Balconies

• If using a hose to wash down the roof area, make sure that, before you do, you sweep up leaves, sand, shells, and other small debris that could wash down the drains and plug them up.

• Do not throw items from the roof or balconies. In the past we have found cigarette butts, soda and beer cans, and animal hair thrown over the railings.

• Please clean animal waste promptly from the decking and do not permit it to wash down the rain gutters.

• To prevent rust staining and indentations in the balconies and roof, no steel or iron-based furniture or other items are permitted. Please use wood or plastic.

• No items are to be placed on the roof or balconies that will trap water beneath them. If you have storage units or other items which could trap water and harm the decking, please put the items up on some type of wood or plastic rails that will allow the water to dry.

Sand and Shared Hose

• Please try to leave sand outside. We have bought a good hose on a reel to help you clean the sand off yourself, boogey boards, beach toys, etc.

• When using the hose on the west side, be considerate of our neighbors in Unit #1; hose off equipment and feet on the grass please.

• Also, this hose is on the water meter for unit #1. While the HOA has compensated the owners of unit #1 for the use of their water and while they don’t mind our using the water, please use this hose sparingly.

Landlord/Tenant Requirements

• At lease or rental agreement signing, our Declarations document requires that the landlord provide a copy of the Declarations to the renter.

• This Rules and Regulations document must also be provided to the renter at lease or rental agreement signing.

• The above two documents contain the rules which the members of the homeowners association are elected to enforce.

• The landlord must obtain a signed acknowledgement that the above two documents have been given to the renter, and this acknowledgement must be delivered to the secretary of the association.

• Within 10 days of lease signing, the landlord shall deliver to the secretary of the association a list of all tenants and members of tenants’ families occupying the premises, and shall deliver to the secretary a complete copy of the lease (6.2.1.e)
